Dana Baiocco is a former commissioner on the Consumer Product Safety Commission (CPSC), the governing body of the independent federal agency charged with promoting the safety of consumer products. As one of five commissioners, Dana contributed to the agency’s overall policy agenda and operational plan and participated in rule-making proceedings, voted on dangerous product bans, and prompted other regulatory actions related to the manufacture, sale, and distribution of consumer products. She and fellow commissioners oversaw, imposed, and/or authorized investigations and litigation, and initiated enforcement and civil penalty proceedings independently or in conjunction with the US DOJ.
In private practice, Dana uses her policy and consumer product litigation experience to counsel clients in many regulated industries on strategies relating to products and manufacturing, internal and government investigations, safety auditing, and creating and implementing related compliance programs. She collaborates with numerous practice areas to advise clients on regulatory and investigative issues and information disclosures.
Dana also represents clients in high-stakes trials involving mass torts, consumer and industrial products, and medical devices in federal, state, and international courts. She represents clients in consumer class actions and other consumer-related litigation. She also counsels on investigations, risk mitigation, compliance with regulatory and reporting obligations, quality control and safety programs, warranties, and product recalls.
Dana is a seasoned litigator in other commercial contexts, including deceptive business practices, competition, construction, mining and machinery, aviation, and component parts manufacturing.
Before joining the CPSC, Dana was a partner in the business and tort litigation practice at Jones Day (1998-2018).
